英文契約書で何かを列挙するときの表現であるincluding, but not limited toとincluding, without limitation について解説します。例文をとりあげ対訳をつけました。例文中の他の基本表現に注記を入れました。
１．解説：
１）including, but not limited toとincluding, without limitationとは
including, but not limited to～は、
～を含むが、それらに限定されない
という意味です。
including, without limitation～も同様に、
～を含むが、それらに限定されない
という意味です。
２）including, but not limited toとincluding, without limitationの使い方
including, but not limited to～と
including, without limitation～
の二つの表現は、対象とする範囲について、具体例を例示する際に、
例示したものに限定させないで、その類似のものにも適用させる「例示列挙」
のために使われます。
英文契約書においては、
・責任制限条項（Limitation of Liability）
・不可抗力条項（Force Majeure）
などでよく使用されます。
なお、責任制限条項（Limitation of Liability）とは、
契約違反がおきた場合に、高額な賠償請求に備えるため、当事者が直面する賠償責任を制限する
ことを規定した契約条文です。
また、不可抗力条項（Force Majeure）とは、
当事者の責に帰せられない不可抗力の状況が起きた場合に、契約の履行が不可能となった当事者が免責される
ことを規定した契約条文です。
責任制限条項（Limitation of Liability）では、賠償責任の具体例を提示するのに

including, without limitation～

不可抗力条項（Force Majeure）では、不可抗力事由を提示するのに、
including, but not limited to～と

３）注意点
注意すべき点があります。
具体例を提示する側としては、including, but not limited toとincluding, without limitationを使うことにより、対象とする範囲が拡大解釈できるため、便利な表現といえます。
しかし、具体例を受ける側としては、including, but not limited toとincluding, without limitationは、例示列挙のため、対象とする範囲が不明確になりやすいことに注意が必要です。

＊With the exception of liability relating toは、With the exception of（～を除き）とliability（法的な責任）とrelating to（～に関連する）の組み合わせで、（知的財産権）に関する責任を除きという意味です。
＊be liable toは、（買主）に対して責任を負うという意味です。

＊sufferは、被るという意味です。
＊in relation toは、（製品に）に関連してという意味です。

不可抗力条項（Force Majeure）からです。不可抗力事由について、including, but not limited toを入れて例示列挙しています。長い英文ですが、訳文は読みやすいように二つに分けました。
Neither party hereto shall be liable to the other party for failure to perform its obligations hereunder or individual contracts due to the occurrence of any event beyond the reasonable control of such party or third parties employed by such party to render all or any part of Services, and affecting its/their performance, including, but not limited to, governmental regulations, orders, or guidance, act of God, war, warlike conditions, hostilities, civil commotion, riots, epidemics, fire, strikes, lockouts or any other similar cause or causes.
