英文契約書の独特の表現であるand/orについて、とりあげます。 併せて、例文をとりあげ対訳をつけました。例文中のその他の基本表現に注記を入れました。
１．解説 ：
andとorの二つの語句を組み合わせたand/orは、日本語契約書にはない、英文契約書に独特の表現です。
and/orは、契約の対象とする事由や事柄を列挙する際に、できる限り広くカバーしてモレがないようにするための言い回しです。
and/orの意味：
以下の三つの意味があります。
①AおよびB
②AまたはB
③AもしくはB、またはその両方
最後の③のAもしくはB、またはその両方は、別の言い方をすれば、AとBの両方、またはいずれか一方ということです。
and/orの訳し方：
訳し方は二通りあります。
ひとつは、および/またはと直訳することができます。
もうひとつは、またはと意訳することができます。 and/orは、対象とする事柄を、できる限り広くカバーするようにするためだからです。
and/orの使い方：
下記の例文①の Indemnification （補償条項）、例文②のForce Majeure（不可抗力条項）、例文③のConfidentiality（秘密保持条項）、例文④のRemedies（救済条項）をご参考にしてください。
２．例文と基本表現：

１）and/or – 例文①
Indemnification（補償条項）からです。補償の対象事由にand/orが使われています。
Seller agrees to indemnify and hold Buyer harmless from any and all claims, damages and liabilities arising from Seller’s breach of its representations and/or covenants set forth herein.
（訳）：
売主は、本契約に規定された売主の表明または誓約に係る、売主の違反に起因したすべての請求、損害及び責任から、買主を補償し免責することに合意する。
（注）：
＊indemnify and hold ～harmlessは、～を補償し免責するという意味です。詳しくは、indemnify and hold harmlessの意味と例文をご覧ください。
＊any and allは、すべての、一切のという意味です。
＊arising fromは、～に起因する、～から生じるという意味です。詳しくは、arising out ofとarising fromの意味と例文をご覧ください。
＊set forth hereinは、本契約に規定されたという意味です。詳しくは、set forthの意味と例文をご覧ください。
２）and/or – 例文②
Force Majeure（不可抗力条項）からの例文です。不可抗力事由の列挙にand/orが使われています。
Neither party shall be liable in damages or have the right to terminate this agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including but not limited to acts of God, government restrictions, wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected.
（訳）：
いずれの当事者も、不可抗力、政府による規制、戦争、暴動または履行の影響を受ける当事者の合理的支配の及ばない他の原因を含むがこれに限らない、やむを得ない事由により、本契約に遅延または不履行が生じた場合、損害賠償責任を負わず、かかる履行の遅延または不履行については、本契約を解除する権利を有しない。
（注）：
＊defaultは、不履行という意味です。
＊conditions beyond its controlは、やむを得ない事由という意味です。

＊acts of Godは、不可抗力という意味です。

Confidentiality（秘密保持条項）からです。秘密情報の対象の定義づけにand/orが使われています。
For the purposes of this Agreement, the term, “Confidential Information,” shall mean confidential and/or proprietary information under the ownership or control of one of the parties.
（訳）：
本契約の目的において、「機密情報」の用語は、一方の当事者の所有または管理下にある機密情報または専有情報を意味するものとする。

＊under the ownership or control ofは、の所有または管理下にあるという意味です。
４）and/or – 例文④
Remedies（救済条項）からです。救済手段を挙げるのにand/orが使われています。
It is agreed that each of the parties hereto shall be entitled, in addition to any other remedy to which they may be entitled at law or in equity, to seek injunctive relief and/or to compel specific performance to prevent breaches by the other party hereto of any covenant or agreement of such other party contained in this Agreement.
（訳）：
本契約の各当事者は、当該当事者が権利を有するコモンローまたは衡平法上の他の救済策に加えて、他の当事者による本契約の誓約または合意事項の違反を防ぐために、差止命令による救済を請求する権利または特定履行を強制する権利を有することに合意する。
（注）：
＊remedyは、救済策という意味です。
