１．解説：

１）by virtue of（ ～によって、～を理由として、～を根拠として）– 例文①
配送不備によって買主が被る損害に対し、会社は、保険金額を超える責任は負いません。
Subject to the Company’s obligations set out in this article, the Company is not liable for any more direct and/or indirect damage or losses which the buyer may suffer by virtue of any defect in the delivery, acknowledged by the Company, than the amount paid out by the Company’s insurer in such cases.
（訳）：
本条項に規定する会社の義務に従い、会社が確認した配送上の不備によって買主が被る直接的若しくは間接的な損害又は損失に対し、会社は、かかる場合に会社の保険業者が支払う金額を超える責任は負わない。

本契約に基づき販売された機器等の産業財産権は、会社とライセンサーに帰属します。
All rights of intellectual and industrial property on the sold and/or supplied equipment, software, or other materials such as documentation, designs, analysis, offers (including preparatory material thereof) by virtue of this Agreement rest exclusively with the Company or its licensors.
（訳）：
本契約に基づき販売又は供給された機器、ソフトウェア若しくは文書、設計、分析、オファーなどその他資料（その準備資料を含む）に関する全ての産業財産権は、会社又はそのライセンサーのみに帰属する。

３）by virtue of this agreement（本契約に基づき）– 例文③
受託業者が本契約に基づき義務を履行しない場合、受託業者は、目的物の損傷・損失の責任を負います。
The Contactor is liable for damage to or loss of objects and for losses due to delays insofar as the Contractor has failed to fulfill his obligations by virtue of this Agreement.
（訳）：
本契約に基づき受託業者がその義務を履行しなかった場合の限りにおいて、受託業者は、目的物の損傷又は紛失及び遅延による損失に対する責任を負う。
（注）：
＊has failed to fulfill his obligationsは、その義務を履行しなかったという意味です。
＊insofar as～は、～の限りにおいてという意味です。
