１．解説：
１）hold itself out asとは
hold itself out as ～は、
～として振る舞う
という意味です。
hold itself out（振る舞う）とas（として）を組み合わせた表現です。
hold itself out to be～という表現もありますが、も同じく、
～として振る舞う
という意味です。
２）hold itself out as ～の使われ方
hold itself out as ～（～として振る舞う）は、特に、英文契約書の
Relationship of the Parties（当事者の関係条項）
で多く使われます。そして、多くは、
shall not hold itself out as ～の形で用いられ、
～として振る舞ってはならない
という禁止の表現になります。
以下のような使い方です。（青字部分）
『契約の両当事者は、独立の当事者の関係にある。一方当事者が、他方当事者に対して、代理権やその他の権限を与えるものでなく、他方当事者はそのような権限を有すると振る舞ってはならない。』（下記の例文①、例文②、例文③をご覧ください）

１）hold itself out as ～（～として振る舞う）- 例文①
Relationship of the Parties （当事者の関係条項）からです。買主も売主も、相手方の代理人として振る舞ってはなりません。
Purchaser and Seller acknowledge and agree that the relationship established between the parties pursuant to this Contract is only that of a seller and a purchaser of property. Neither Purchaser nor Seller is, nor shall either hold itself out to be, the agent, employee, joint venturer or partner of the other party.
（訳）：
買主と売主は、本契約に従って当事者間に確立された関係が、資産についての売主と買主としての関係のみであることを確認し合意する。買主も売主も、相手方の代理人、従業員、合弁事業者又はパートナー組合員ではなく、かかる関係者として振る舞ってはならない。

２）hold itself out as ～（～として振る舞う）- 例文②
Relationship of the Parties （当事者の関係条項）からです。いずれの当事者も、他の当事者を拘束する権限を有するとして振る舞ってはなりません。
Notwithstanding anything herein to the contrary, each party hereto shall be and remain an independent contractor and nothing herein shall be deemed to constitute the parties as partners; neither party will have the authority or hold itself out as having the authority to bind the other.
（訳）：
本契約の別段の定めにもかかわらず、本契約の各当事者は、引き続き独立した契約者であり、パートナーとしての当事者を構成するとはみなされない。 いずれの当事者も、他の当事者を拘束する権限を有しておらず、かかる権限を有するとして振る舞ってはならない。

３）hold itself out as ～（～として振る舞う）- 例文③
Relationship of the Parties （当事者の関係条項）からです。いずれの当事者も、相手方の名義で他の契約を締結する権限を有するとして振る舞ってはなりません。
Neither Party to this Agreement has, and shall not hold itself out as having, any authority to enter into any contract or create any obligation or liability on behalf of, in the name of, or binding upon the other Party to this Agreement.
（訳）：
本契約のいずれの当事者も、本契約の相手方当事者に代わって、相手方当事者の名義で若しくは相手方当事者を拘束して、他の契約を締結する又は義務若しくは責任を生じさせる権限を有さず、かかる権限を有するとして振る舞ってはならない。
